This Privacy Policy ("Policy") applies to trainwithswan.com and ANWAR CORNELIUS OTHMAN GLENN TR ("ACOG TR") and governs data collection, use, and retention for all Services offered through trainwithswan.com. By using our Services, you consent to the data practices described in this Policy.

Given the nature of our Services — fitness and nutrition coaching — we collect and handle sensitive personal health data. We take this responsibility seriously and are committed to handling your information with care, transparency, and respect.

Section 01

Information We Collect

Personal Identification Information
  • First and last name
  • Mailing address
  • Email address
  • Phone number
  • Date of birth
Health and Fitness Data

Because we provide fitness and nutrition coaching, we collect sensitive health and body data, including:

  • Height, weight, and body measurements
  • Fitness goals and activity levels
  • Medical history, pre-existing conditions, and injuries (as disclosed on intake forms and PAR-Q)
  • Medications and supplements
  • Dietary preferences, restrictions, food allergies, and intolerances
  • Nutrition logs and macronutrient data
  • Progress photos (with explicit consent)
  • Workout and session performance data

This health and fitness data is collected solely to deliver safe, personalized coaching services. It is treated with the highest level of confidentiality and is not used for marketing, sold, or shared with third parties except as described in this Policy.

Payment Information

Billing and payment information is processed securely through Stripe. We do not store full credit card numbers on our systems.

Automatically Collected Information

We may automatically collect device and browsing information including IP address, browser type, domain names, access times, and referring website addresses. This is used for service operation and quality maintenance.

Section 02

Use of Technology Tools & AI Platforms

Our coaches may use technology tools, including AI platforms such as Anthropic's Claude, as internal productivity aids — such as aggregating nutritional data, compiling macronutrient totals, and formatting program documentation. These tools function similarly to a spreadsheet or calculator: they support the coach's work but do not independently generate or deliver coaching advice.

When AI tools are used in this capacity, we take the following precautions:

  • We minimize personal information entered into AI platforms, using general coaching parameters rather than full client profiles where possible
  • We do not enter sensitive medical information, full names, or payment information into AI tools
  • All AI-assisted outputs are reviewed and verified by a certified coach before being delivered to any client

By using our Services, you consent to this limited, back-office use of AI productivity tools. For information on how Anthropic handles data, please refer to Anthropic's Privacy Policy.

Section 03

Progress Photos & Body Image Data

Progress photos and body composition images are among the most sensitive data we handle.

Collection and Storage
  • Progress photos are collected only when relevant to your coaching program and only with your knowledge
  • Photos are stored securely and accessible only to your assigned coach and authorized Company personnel
  • Photos are never shared with third parties except as required by law
  • Photos of minor clients require separate, explicit written consent from a parent or legal guardian
Marketing and Promotional Use

Progress photos, before/after images, and client likeness will NEVER be used in any marketing, social media, advertising, or promotional content without your explicit, separate, prior written consent. This consent is entirely optional and has no bearing on your coaching services. Progress photos of minor clients will never be used in any marketing under any circumstances, regardless of parental consent.

Retention and Deletion

Progress photos and body composition data will be retained for the duration of your active coaching relationship and for up to two (2) years following the end of your last active coaching period, unless you request earlier deletion.

Section 04

Data Retention

We retain different categories of data for different periods based on legal, operational, and business needs:

  • Active client health and coaching data — Duration of coaching relationship plus two (2) years
  • Payment and transaction records — Seven (7) years (tax and financial record-keeping requirements)
  • Health intake forms and PAR-Q documents — Five (5) years following end of coaching relationship
  • Progress photos — Two (2) years following end of coaching relationship unless earlier deletion is requested
  • Email and communication records — Three (3) years
  • Website usage and analytics data — Up to two (2) years

At the end of the applicable retention period, data is securely deleted or anonymized.

Section 05

Use of Your Personal Information

We collect and use your personal information to:

  • Deliver and manage the coaching services you have requested
  • Communicate with you regarding your program, appointments, and account
  • Process payments and billing
  • Design, deliver, and adjust personalized exercise and nutrition programming
  • Ensure the safety and appropriateness of coaching services based on your health disclosures
  • Comply with legal obligations
  • Improve our Services and internal processes

We will not use your personal information for purposes beyond those listed above without your explicit consent.

Section 06

Sharing Information with Third Parties

The Company does not sell, rent, or lease client data to third parties.

We may share limited information with trusted third-party service providers who assist us in operating our business, including:

  • Stripe (payment processing) — subject to Stripe's own Privacy Policy
  • Cloud hosting and data storage providers — bound by confidentiality obligations
  • Email communication platforms — used solely for client communications

We may disclose your personal information without notice if required to do so by law or in the good faith belief that such action is necessary to comply with legal process, protect the rights or property of the Company, or protect the safety of our clients or the public.

California Consumer Privacy Act (CCPA) Rights

As a California-based business serving California residents, we comply with the CCPA. California residents have the following rights:

Right to Know

You have the right to request information about the categories and specific pieces of personal information we have collected about you, the sources, purposes, and any third parties with whom it was shared.

Right to Delete

You have the right to request deletion of your personal information, subject to certain exceptions required by law. Note that deletion of health data may limit our ability to provide safe coaching services.

Right to Non-Discrimination

We will not discriminate against you for exercising your CCPA rights. We will not deny services, charge different prices, or provide different quality of service based on your exercise of privacy rights.

Sensitive Health Data

We recognize that health, body composition, and fitness data constitutes sensitive personal information under the CCPA. We collect this data solely for delivering coaching services and apply heightened protections to it as described throughout this Policy.

To exercise any of these rights, contact us at support@trainwithswan.com. We will respond to verifiable requests within 45 days.

Section 08

Your Rights & Data Deletion Requests

To submit a data deletion request, email support@trainwithswan.com with the subject line "Data Deletion Request" and include your full name, email address on file, and a description of the data you would like deleted. We will respond within 45 days.

We may not be able to delete data if retention is required to: complete an active transaction; fulfill a contract; comply with a legal obligation; detect or prevent fraud; or for other lawful internal purposes compatible with the context in which you provided the information.

Section 09

Age Policy

Our Services are available to users who are at least 18 years of age. Users under 18 may access Services only with documented written consent from a parent or legal guardian, who co-signs all agreements and assumes full responsibility for the minor's participation.

We do not knowingly collect personal information from children under the age of 13 through our website without parental consent. All personal and health data collected in connection with minor clients is subject to the same protections described in this Policy, with additional restrictions on photo use and marketing as described in Section 3.

Section 10

Security of Your Personal Information

The Company takes reasonable technical and organizational measures to protect your personal information from unauthorized access, use, or disclosure, including SSL encryption for data transmission and secure storage practices for health and body data.

However, no data transmission over the Internet can be guaranteed to be 100% secure. While we strive to protect your information, you acknowledge that there are inherent security limitations to Internet-based data transmission that are beyond our control.

Use of Cookies

Our website may use cookies to enhance your browsing experience. Cookies are small text files placed on your device by our web server. They help us recognize returning visitors and recall preferences. You may configure your browser to decline cookies, though this may limit some website functionality.

Section 12

Email Communications

We may contact you via email for service updates, session reminders, program deliverables, and coaching communications. We may also send promotional communications about our Services. If you wish to stop receiving marketing emails, click the unsubscribe link in any marketing email. Transactional and service-related emails are not subject to opt-out as they are necessary for delivering your Services.

Section 13

Changes to This Policy

The Company reserves the right to update this Privacy Policy at any time. When material changes are made, we will notify active clients by email to the primary email address on file and by posting a prominent notice on trainwithswan.com. Your continued use of our Services following notification constitutes acceptance of the updated Policy.
